A community residence is defined by the City of Delray Beach Land Development Regulations, pursuant to State of Florida law.

Review and Approval Process 

A Community Residence Zoning Verification Form  must be submitted for every proposed community residence of any size for people with disabilities that seeks to open beginning July 19, 2017, pursuant to the regulations adopted with Ordinance No. 25-17. This verification form enables staff to determine whether the proposed community residence: 

  • Is allowed as of right, the same as any other family
  • Is allowed as of right or requires a conditional use permit in the zoning district in which the home would be located
  • Would house no more than the maximum number of occupants allowed under the City’s building code that applies to all residential uses
  • Needs to apply for a reasonable accommodation to house more than 10 people
  • Provides at least the minimum number of required off-street parking spaces

Subsequent to City staff review, if a community residence meets the criteria to operate at the particular location, the proposed community residence will be required to submit the full application and proof of license.
